What is litter?

Anything dropped, thrown, or deposited in a place other than a litter bin or somewhere where it is authorised to be left.

It might be something as small as a piece of chewing gum, sweet paper or a cigarette butt, or as large as a carrier bag. It can be one item or lots of things scattered around.

Litter is in the ‘wrong place’ if it isn’t in the bin or a pocket or bag to take it home. Things dropped on the ground, left behind on seats, stuffed into cracks in walls, thrown over fences and into the road are all litter.

Residents who are caught dropping litter could be liable for a fine of £80, payable within 14 days. If paid within 10 days the fine is reduced to £60.

Someone spitting or urinating is not regarded as littering. This is a police matter and should be report to them by calling 101.

Can I challenge the FPN?

Information on the appeal process and who to write to can be found on your FPN or its corresponding letter. You can write to that address detailing why you think you should not have been issued with an FPN or if you think it was incorrectly issued. All representations will be considered on their individual merits by an officer who is not involved in the case. Remember to quote the FPN reference on all correspondence.

Under the Environmental Protection Act 1990 and the Clean Neighbourhood and Environment Act 2005, the Council can serve notices to anyone committing this offence in any place that is open to the air. Refusing to pay could lead to prosecution, which could result in a fine of up to £2,500 if it is successful. The Council has produced a leaflet about litter and FPNs.
